Initiative 148 establishes laws regarding dispensaries and caregivers. Caregivers must be designated by the patient and have the responsibility for assisting the patient in the safe use of medical marijuana, and providing medical cannabis to patients. A caregiver may care for up to three (3) qualifying patient at a time, and may grow up to twelve (12) seedling plants and four (4) mature plants for each patient. Montana caregivers must submit to a finger print background check and a financial background check. Patients and caregivers wishing to grow for personal use must also submit a notarized Landlord Permission Form to the Montana state Registry. Initiate 148 does not give guidelines concerning the designation of dispensaries. The law allows for Registered Premises, which are locations where a provider or marijuana infused product provider may cultivate or manufacture medical marijuana for registered card holders.
